TERMS AND CONDITIONS
GENERAL INFORMATION
These terms and conditions apply to every order placed and every agreement reached through zurik.es.
By completing an order in the ONLINE STORE, you accept these terms and conditions.
1- ORDERS AND SALES CONTRACTS
a. The products displayed in the ONLINE STORE are part of an online catalog offered directly between the artist and the buyers, without intermediaries.
b. After placing your order, we will send you an email confirming that your payment has been successfully received. Once confirmed, you will be bound by the purchase terms mentioned herein.
c. A binding sales contract takes effect once payment is received and the product shipment is confirmed.
d. If payment is not successfully processed, the order will be automatically canceled and the sales contract will not take effect.
e. If the payment has been made correctly and you do not receive the confirmation email, please write to us at info@zurik.es to confirm receipt. Depending on the chosen payment method or your bank, some payments may take up to a few hours to be reflected.
2-INTERNATIONAL ORDERS
a. We accept orders from any country in the world.
b. Purchases made outside of Europe may be subject to customs charges. If such charges apply, it must be paid at time of delivery. Zurik.es is not responsible for the additional costs that are imposed, this is in the policy of each country and is out of our control.
3-INVENTORY
a. If a product is out of stock and, due to an error, is not displayed as such, we will contact you immediately to cancel or modify the order.
b. Most products are limited editions, meaning that once they are sold out, they will not be available for sale again.
4-PRICES
a. All prices are shown in EUROS.
b. Prices exclude shipping costs. (FREE shipping for purchases over €200)
c. Exact shipping costs are automatically calculated when you enter your full address at CHECKOUT.
d. Zurik.es has the right to cancel the products sold in the event that the prices are displayed incorrectly due to technical failures.
5-PAYMENT
a. You can pay for your order using any of the following payment methods: Credit or debit card (via STRIPE), Apple Pay, Google Pay, or PayPal.
b. When you have completed your payment you will be redirected back to Zurik.es
6-SHIPPING
a. Your order will be shipped within 1 to 2 business days after your payment is received and confirmed.
b. As soon as your order is shipped, you will receive a confirmation email including details of the courier company and tracking number.
c. Shipping outside of Spain generally takes between 10 and 15 business days from the day of shipment. Within Spain, it usually takes about 2–3 days.
d. These delivery times are an indication and not a guarantee, as they depend on various external factors. Delivery times longer than those indicated here will not entitle you to compensation, to cancel the order (if it has already been shipped), or to revoke the sales contract.
e. Although unlikely, customs officials are authorized to open packages for inspection; this depends on each country and is out of our hands, so we cannot accept responsibility for any orders delayed by foreign customs. In addition, the Customs agency of your country may impose additional charges that are not included in our products or shipping charges. Even so, our customers report that they have never incurred extra charges.
f. We ship our products with various companies; depending on the country you are in, you can see this information on the CHECKOUT page. In the case of standard shipping, international packages are generally handled by a second national transport company in the destination country once the package has cleared customs. The number of delivery attempts varies depending on the delivery country and the local company handling the shipment. In general, there are two delivery attempts before the package is taken to a receiving center / delivery point of the company where it remains for about 15 days; in such a case, the transport company will inform you. If you do not collect your package from the designated collection address and it is returned to the origin, a new delivery will be scheduled if you so wish, upon paying the shipping costs again.
g. All packages require delivery signature. Therefore, it is important that someone is present at the address at the time of the address.
h. You should never accept a package that shows signs of damage. In the unlikely event that the shipping company attempts to deliver a damaged package, refuse it and send an email to info@zurik.es to inform us of the situation on the same day. After this period, we are not responsible for refunds or returns.
In the event that you have accepted a package that shows no signs of external damage but the product is damaged, do not handle it and send an email to info@zurik.es with images of the damaged product and its original packaging on the same day or at the latest the day after accepting the package. After this period we are not responsible for refunds or returns. We will contact the transport company to notify them of the situation and propose solutions to replace the product.
i. If you entered an incorrect address during the ordering process, or any other information, write to us as soon as possible and we will try to modify it. If we have already sent the package we will have to wait to recover it to re-send it to the correct address, in this case we will charge an additional shipping charge equal to your original order.
7-RETURNS
a. You may return any unused product within a maximum period of 14 CALENDAR days (including Sundays) from delivery.
To proceed with the refund, the product must be returned in good condition and the value of the product must not be affected. We do not refund products returned that have been used or damaged. Therefore, we recommend that you carefully wrap any product to be returned to prevent damage.
b. Shipping and handling costs for return shipments are non-refundable. As we are a small business with a customer base in several countries around the world, we cannot assume return shipping costs. Please note that you should NEVER accept a package that shows signs of damage.
d. To receive a refund, send an email to info@zurik.es stating your order information and explaining why you wish to return the product. If you return your product without first informing you, you risk not receiving a refund. Therefore, you SHOULD ONLY RETURN THE PRODUCT after receiving our confirmation email.
e. We will refund you once we have received the complete product, unused and in good condition. An email confirmation and an immediate refund will be sent as soon as we receive the returned product. You will receive your refund through the same payment method used to make your purchase.
f. In the event that you return only parts of the order or if you return the product in poor condition, you will be entitled to receive the value corresponding to what you have returned. The refund will be the equivalent of the returned products, and in case of damage, only 50% of the value will be refunded (excluding shipping costs).
g. When you send us back a product, we will indicate the address to which you must do it, do not return the product to the same address from which it was sent.
8-WARRANTY
a. In the event of a damaged product or if we send the incorrect color or size of the product you ordered, you are entitled to the delivery of a new one that is free of damage at no additional cost. In the event that the requested product is no longer available, you have the right to choose a different one that has the same value or to cancel the order. Damaged or incorrect product must be returned to the return address. As long as you can send us a copy of the receipt, we will pay the shipping costs you incur when returning the product. An immediate refund will be issued as soon as we receive the product.
b. In the event that the product you return to us shows no damage and matches the size or color you ordered, you will be entitled to receive a refund of the product value, excluding shipping costs.
c. Zurik.es will not compensate for any damage that occurs to products due to poor handling by the customer when shipping the product back.
9-LIABILITY
a. We are not obliged to pay compensation for damages, except if and to the extent that the damage suffered was inflicted intentionally or through negligence on our part. However, Zurik.es’s liability for loss of profits, direct or indirect damages is excluded at all times.
b. In all cases where Zurik.es is obliged to pay compensation for damages, it will never exceed the invoice value of the product, or, if the damage is covered by a Zurik.es insurance policy, the amount paid by the insurer.
c. Any claim, except those recognized by Zurik.es in accordance with these terms and conditions, will expire after a period of 3 months from the time the claim arose.
d. This website contains links to third-party websites and services that are not operated by Zurik.es. We are constantly checking for updates and making sure everything is working properly but we are not responsible, under any circumstances, for the content and quality of these websites and services. If you have any problems with Third Party services, please write to us and we will be happy to help you.
10-FORCE MAJEURE
a. Zurik.es has the right to invoke force majeure if the implementation of the sales contract is, totally or partially, affected by circumstances beyond our control. These circumstances shall include, but are not limited to, site or construction blockades, strikes, work interruptions, delays in the provision of parts, goods, or services ordered from third parties, accidents, and business operation interruptions.
b. In the event of force majeure, you will be notified as soon as possible by email.
c. In case of force majeure, the obligations described herein are suspended. If the force majeure lasts for more than three months, Zurik.es and you, as a customer, are authorized to revoke the sales contract.
11-APPLICABLE LAW
a. Spanish law exclusively governs the agreements reached and orders placed through Zurik.es.
b. All disputes arising between customers and Zurik.es will be resolved by a Spanish judge in a Spanish court of law, specifically a court of law in the city of Barcelona, regardless of the customer’s residential address.
12-COPYRIGHT AND INTELLECTUAL PROPERTY
a. Zurik.es owns the rights to use all photos and texts displayed on this website.
b. Zurik.es is and remains the sole and exclusive owner of all products, trade names, brand names, domain names, copyrights, and designs, both registered and unregistered, presented here.
c. In no case will customers be granted ownership and/or reproduction rights belonging to Zurik.es.
d. Customers and other users or visitors to the website are not permitted to register or use Zurik.es’s property rights in any way.
Third-party copyrights: Photographs included on this website that are the intellectual property of third parties—photographers / festivals, etc.—and that portray the artist or her work, will include the author’s name in the caption and will be used solely for informational purposes or as part of the artist’s portfolio, and never directly as part of any product or commercial agreement. Therefore, they will not give rise to any financial compensation from ZuriK.es. In any case, if the author of said photograph wishes for it to be removed from the website, they must write to info@zurik.es expressing their request, and depending on the agreements reached, the photograph may be permanently removed from this website.
13-DISCLAIMER
Despite the constant care and attention we devote to the composition and quality of the content, it is possible that some information provided may be incomplete or incorrect. As such, we exclude all liability for any direct or indirect damage arising from or related in any way to the use of this information, and we would appreciate it if you could inform us of any doubts or errors so that we can resolve them as soon as possible.
